Two Houston Men Arrested on Burglary of Vehicle Charges in Sealy

SEALY, Texas — Two Houston men were arrested early Friday morning after Sealy police officers reportedly interrupted an alleged vehicle burglary in progress.

According to the Sealy Police Department, officers on patrol around 4 a.m. on July 11 observed suspicious activity in the 2300 block of Highway 36 South. After investigating, officers determined that a vehicle was in the process of being burglarized.

Police arrested Erin Garner, 32, of Houston, on a charge of Burglary of a Vehicle.

Keuntae Bates, 23, of Houston, was also arrested and charged with Burglary of a Vehicle. In addition, Bates was taken into custody on an outstanding warrant for Burglary of a Vehicle issued by another jurisdiction.

Under Texas law, Burglary of a Vehicle occurs when a person breaks into or enters a vehicle without the owner’s effective consent with the intent to commit theft or another felony. The offense commonly involves stealing items from inside a vehicle, although no property must actually be taken for the charge to apply if the unlawful entry was made with criminal intent.

Burglary of a Vehicle is generally a Class A misdemeanor, punishable by up to one year in county jail, a fine of up to $4,000, or both. The offense may be enhanced to a state jail felony if a person has certain prior convictions for the same offense.

As with all criminal cases, the charges are allegations, and both men are presumed innocent unless and until proven guilty in a court of law.
