The Waller County Sheriff’s Office is seeking the public’s help in locating Miguel Chan, a fugitive who has been on the run since 2009 after being indicted by a Waller County Grand Jury on four felony charges involving a child.

 

 

Miguel Chan was indicted on April 23, 2009, on two counts of Aggravated Sexual Assault of a Child and two counts of Indecency with a Child. He was arrested on February 25, 2009, and later released on bond on July 30, 2009. Authorities report that Chan fled the area shortly after his release and has remained at large ever since.

Investigators believe he may currently be residing in Tampico, Tamaulipas, Mexico, with family members, including his parents, wife, and young children. According to law enforcement records, Chan provided a written statement admitting to the allegations before absconding.

 

 

Penalties Under Texas Law

The multiple charges against Chan carry extremely serious penalties under Texas law:

  • Aggravated Sexual Assault of a Child (first-degree felony): is punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000. In cases involving very young victims or certain prior convictions, the minimum sentence can increase to 25 years to life.
  • Indecency with a Child by Contact (second-degree felony): is punishable by 2 to 20 years in prison and a fine of up to $10,000.
  • Indecency with a Child by Exposure (third-degree felony): is punishable by 2 to 10 years in prison and a fine of up to $10,000.

Convictions for either indecency offense also require mandatory sex-offender registration.
